When a virtual office appears to be a regional branch and how location claims, registered offices, business profiles and evidence are reviewed under the Austrian UWG.

The term “regional branch” normally conveys a local business presence. This may include premises, reachable contact persons and a service offered at the stated location. If the address is only a postal or registered-office service provided by a virtual office, the complete business presentation must reflect that fact.

Section 2 of the Austrian UWG covers misleading statements that can influence a market participant’s business decision. In consumer transactions, Directive 2005/29/EC provides the European framework for misleading actions and omissions. An inaccurate impression about a location can therefore raise competition-law issues.

The specific communication is decisive. The address, wording, map marker, photographs, opening hours, local telephone number and appointment option work together to create an impression of a location. A registered office or a reception service alone does not answer whether that impression is accurate.

Important boundary: A business address must not be presented through wording and design in a way that suggests a regional branch when customers will not find the corresponding business presence there.

What the audience understands by a regional branch

In business communications, a regional branch is generally understood as a local part of the business. The precise expectation depends on the sector. For a law firm, consultancy, retailer or service provider, it may include personal availability, its own premises, staff or regional handling of the assignment.

The overall impression on the addressed audience matters for the legal assessment. The heading works together with the address, map marker, photographs, opening hours and contact route. A single clarification can only partly qualify a much stronger initial impression.

The advertising should therefore show which service is actually offered at the stated location. “Postal address in Salzburg” and “meeting room by appointment” create a different expectation from “our Salzburg branch” or “personal service on site”. The wording must reflect the real organisation.

Distinguish a virtual office, business address and real presence

A virtual office can provide different services. These may include use of a business address, receipt of mail or a meeting room that can be booked temporarily. Such services alone do not establish a continuously operated regional branch.

A fact matrix helps with the review. It records premises, access, staff, availability, signage, meeting options, services offered and their availability over time. The matrix must reflect the situation a customer will encounter when using the advertised contact route.

A regional claim can be worded accurately when it describes the actual service precisely. “Postal address in Salzburg” or “meeting room by appointment” creates a different expectation from “Salzburg branch”. The design must not broaden the limited wording again through photographs or map presentation.

Review the advertising claim and overall impression together

Misleading communication can result from an express statement. It can also arise from several individually accurate details working together. A correct address, a local telephone prefix and a photograph of a reception area may collectively suggest dedicated business premises even though the corresponding service is not provided there.

Review every visible version from the perspective of the target audience. This includes search ads, landing pages, homepages, contact pages, map listings, social-media profiles and offer documents. Every channel should convey the same information about the nature and scope of the presence.

Take particular care with phrases such as “on site”, “locally represented”, “location” or “branch”. Internally, each phrase should be linked to a specific service and responsible process. A later explanation on a subpage is not reliable if the prominent claim promises a stronger presence.

Assess the company register, website and business profile separately

The registered office answers a company-law question. It shows where the business is registered. The registered office alone does not establish a customer-facing branch with its own premises, staff and regional service.

A business profile on a map service or a map marker also does not automatically prove the facilities. Such details form part of the public market presentation and may reinforce a regional expectation. The address, category, photographs, opening hours, reviews and contact route must therefore match the real operations.

Preserve complete evidence before publication

Before approval, a location file should connect the specific claim with the organisational facts. It may include lease or use arrangements, room plans, access, signage, staff allocation, opening hours, appointment process and the services provided at the location. Not every internal document belongs in the advertising, but every visible claim needs a reliable basis.

Archive the approved version with its date and channel. Save search ads, landing pages, map profiles, photographs, videos, PDFs and automated replies. If the address, staff, room availability or appointment process changes, review the advertising again.

Classify a challenge and the next steps

After a challenge, preserve the letter, date of service and challenged versions separately. The further review should identify who published or commissioned the claim. Possible participants include the business, an agency, a platform or the operator of a business profile. Responsibility depends on the actual processes and cannot be inferred solely from the name displayed on the website.
